According to the regulations on tourist flats in Catalonia, a property is considered to be for tourist use if it is ceded by its owner or by a manager to a third party, with a certain amount of repetition, for a seasonal stay, in exchange for money and with characteristics of immediate availability.
These properties are assigned in their entirety, and assignment for stays is not permitted.
In order to be considered a seasonal stay, the property must be ceded in a contiguous period of time equal to or less than 31 days. In order for the transfer to be repeated, the home must be transferred two or more times in one year.
REQUIREMENTS FOR TOURIST HOUSING IN CATALONIA
The housing must have the certificate of habitability, where it is stated that the housing has the basic conditions of habitability, respecting the technical and quality conditions required of housing.
Housing with more places than those indicated in the certificate cannot be occupied.
The home must have enough furniture, appliances and household items for immediate access to it, in order to offer a complete housing service.
The owner or manager of the home must provide guests and neighbours with a telephone number for queries and incidents.
The owner or manager must guarantee an assistance and maintenance service for the home.
REGISTER OF OCCUPANTS
In accordance with the regulations on tourist rentals in Catalonia, the person who owns or manages the property must send an entry form with information about the guests to the Directorate General of Police.

GET YOUR TOURIST RENTAL LICENSE IN CATALONIA
Once you meet the above requirements, it will be necessary to legalize your tourist rental in Catalonia.
To do this, you must notify the relevant Town Hall when the activity begins. The prior communication document contains the following:
-Data on the property and its maximum capacity.
-Data on the owner.
-Telephone number of the owner of the property so that any queries regarding the tourist accommodation activity can be dealt with immediately.
-Identification of the assistance and maintenance company of the property.
-Declaration of responsibility.
Once the Town Hall receives this document, it will notify the Catalan Tourist Board. This institution will be responsible for verifying that the property in question meets the requirements for subsequently issuing the licence.
REGULATIONS FOR TOURIST FLATS IN BARCELONA 2020
The implementation of housing for tourist use in Barcelona is regulated by the Special Urban Plan for Tourist Accommodation (PEUAT). This plan aims to make tourist accommodation compatible and to try to reduce the negative impact that tourism can have on residents.
The PEUAT divides Barcelona into 4 specific areas with their own regulation. Each zone has a different number of places based on the resident population and public spaces.
AREAS WHERE THE REGULATIONS FOR TOURIST FLATS IN BARCELONA APPLY
Zone 1: Rambla, Plaza Espanya, Vila de Grácia and surroundings.
This area stands out for being in a period of decline. No new tourist establishments can be established and existing ones cannot be extended.
It concentrates 60% of the accommodation places in Barcelona.
If an establishment is cancelled in zone 1, a new one can be opened in zone 3, in accordance with the conditions determined by that zone.
Zone 2: Sagrada Familia, Sant Antoni, Les Corts and surroundings.
In this zone, the aim is to maintain the current number of places and the expansion of existing establishments is not allowed.
However, if an establishment is withdrawn from this zone, another one with the same number of places may be implemented or it may be relocated to zone 3, under the conditions of that zone.
Zone 3: Ronda de Dalt , Meridiana, Gran Vía and surroundings.
Here, it will be allowed to implement new establishments and expand the existing ones.
In this area growth will be a reality until the maximum density of places is reached, established by the current offer of tourist accommodation.
When there is a drop in the number of establishments in zones 1 or 2, a new establishment may be opened in zone 3, provided that there are no more than 387 establishments
Establishments may only be located in blocks where the density between the number of tourist homes and residential homes is not exceeded by 1.48%.
Zone 4: Passeig Zona Franca, Meridiana, Plaza de las Glorias and surroundings.
This area is represented by areas of great transformation such as the Marina del Prat Vermell or La Sagrera. These areas have diverse characteristics such as the intensity of construction or the urban position which means that new homes for tourist use are not permitted.
